Terms of Use

The terms for using OdoWorks, its plans and subscriptions.

Effective November 3, 2026Updated November 3, 2026

These Terms of Use (the “Terms”) set forth the terms and conditions that govern your use of the OdoWorks mobile application (the “App”), the website at odoworks.app, which mileworks.app also leads to (the “Site”) and the support and other services offered by or through OdoWorks (together, the “Services”).

BY DOWNLOADING, INSTALLING OR USING THE APP, USING THE SITE, ACCESSING ANY INFORMATION FROM THE APP OR THE SITE, BUYING A PLAN, OR MANIFESTING YOUR ASSENT TO THESE TERMS IN ANY OTHER MANNER, YOU UNEQUIVOCALLY AND EXPRESSLY AGREE TO BE BOUND BY, AND SHALL BE SUBJECT TO, THESE TERMS.

PLEASE READ CAREFULLY BEFORE USING ODOWORKS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE ODOWORKS IN ANY WAY OR FOR ANY PURPOSE WHATSOEVER. THESE TERMS EXCLUDE WARRANTIES AND LIMIT OUR LIABILITY (SECTION 17), EXCEPT WHERE THE LAW DOES NOT ALLOW IT.

These Terms set out the legal terms between you (as an individual, or the business you use OdoWorks for) and MileWorks LLC, a New Mexico limited liability company (“OdoWorks,” “we,” “us” or “our”). You accept them when you use the Services. You may print or save a copy for your records, and we recommend you do. They remain in effect from the date you accept them until they are ended by you or by us as Section 16 says.

1. Before the release

OdoWorks isn’t available to the public yet: its full release is expected in early 2027, and nothing is on sale. Until then it runs only as Android test builds, which may have bugs, change or stop working, and an update may need a new install. If you use a test build, keep a recent export of your log (Section 10). Features shown as coming aren’t part of the Services until they’re released.

2. Who may use OdoWorks

You cannot accept these Terms if: (a) you are not lawfully entitled to use the Services under the laws of the country where you are located or resident; or (b) you are not of legal age to form a binding agreement with us. By accepting these Terms, you confirm that you have reached that age where you are located or resident, or that you have your parent’s or legal guardian’s permission where the law requires it. If you accept these Terms for a business, you confirm that you have the authority to bind it, and “you” includes it.

You may not use the Services in or from a country under a United States embargo, or if you are on a United States government list of prohibited or restricted parties.

Some countries restrict the use of location tracking, of phones in vehicles, or of apps like OdoWorks. It is your responsibility to make sure that downloading and using the Services is lawful where you are.

3. Drive safely

  • Set OdoWorks up before you drive. While the car is moving, don’t type in the App or tap its notifications: leave that to a passenger, or do it once you’ve parked.
  • Driving now and a drive’s notification are there to glance at, like your car’s own screen, with the phone in a mount. Follow the law where you drive: many places ban holding or using a phone while driving.
  • Speeds and distances come from GPS and can be wrong. Go by your speedometer and the road signs, never the App.

OdoWorks isn’t a navigation or driver-assistance system. You alone are responsible for how you drive and for obeying the law, and you use the App while driving at your own risk.

4. Free trial

When paid plans open, a new subscriber may get the first month of a subscription free, once per App Store account, with every feature of that plan. It becomes a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends (Section 7).

5. Right to refuse service

OdoWorks reserves the right to refuse, suspend or limit the Services for anyone, at any time, for any lawful reason, such as: using the Services for purposes they weren’t made for; getting around a plan’s locks, the App Store’s purchase checks or any other technical limit; using an unreasonable amount of the Services’ resources; using them to track another person without that person’s knowledge and consent; using them to make a false record (a mileage log, a reimbursement report, a vehicle history or a tax record must show what really happened); or abusing these Terms, as determined by OdoWorks.

6. Payment and refunds

Nothing is on sale yet. When paid plans open:

  • The plans. OdoWorks Lite is free. Plus and Pro are subscriptions, monthly, every 6 months or yearly. Pro + Automatic tracking is a yearly subscription that includes everything in Pro. Plans are for one person; Family Sharing of plans isn’t offered for now.
  • Pro for life is a single purchase. It gives you Pro, with the features we add to Plus and Pro later, for as long as we offer OdoWorks, on the App Store account you bought it with. It doesn’t include automatic tracking (which a Pro for life owner can add as its own yearly subscription), nor features that need servers we run, such as accounts or sync, if we add them.
  • Where you pay. OdoWorks’s paid Services are purchased through Apple’s App Store or Google Play (each an “App Store”). Prices, subscription terms, billing, renewals, cancellations and refunds are also subject to the terms of the App Store you buy through. The App Store, not OdoWorks, processes the payment and any refund request under its own terms and policies, subject always to rights that cannot be excluded under applicable law.
  • Renewal. A subscription renews automatically for the same length until you cancel (Section 7).
  • Price changes and offers. OdoWorks reserves the right to change its prices or offer promotions, as permitted by applicable law. The App Store tells you before a price rise applies to you.
  • Refunds. Apple decides refunds of purchases made through it (reportaproblem.apple.com). On Google Play you may get a refund from Google within 48 hours of buying; after that, contact us (Section 21).
  • When a plan ends, nothing you’ve logged is deleted, and every CSV export still has all of it. Some features pause until you subscribe again, as the support page explains.

7. Cancellation

You may cancel a subscription in the settings of the App Store account you bought it with: deleting the App doesn’t cancel it. Cancellation takes effect at the end of the period you’ve paid for, and you keep your plan until then. Buying Pro for life doesn’t cancel a subscription: cancel it yourself. Except as required by applicable law or the App Store’s terms, cancellation does not entitle you to a refund of amounts already paid for the current period.

8. New features and changes to these Terms

We may from time to time introduce new features, or modify or remove existing ones, and the App downloads its updates by itself. We will post any new or modified terms on this page and update the date above, and we’ll tell you in the App when a change matters to you. New or modified terms take effect for you on the earlier of (i) your use of a new or modified feature to which they relate, or (ii) the start of your next subscription period (with no subscription, when you next use the Services after we’ve posted them). If you don’t agree to them, stop using the Services and cancel any subscription before then. A change never applies to a period you’ve already paid for.

9. Limited licence

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the App on devices you own or control, and the Site, for your own driving records and those of your household or business, solely in accordance with and subject to these Terms and the App Store’s rules.

Except as these Terms or the law expressly allow, you may not: copy, distribute, resell, rent, lend, publicly perform or publicly display any part of the Services; modify, translate or make derivative works of them; reverse-engineer, decompile or disassemble the App, or try to derive its source code; remove or alter any notice of ownership; use any “deep-link,” “page-scrape,” “robot,” “spider” or other automatic device, program, algorithm or method to access, copy or monitor any part of the Services; or use the Services in a way that overloads, damages or interferes with them or with anyone else’s use of them.

The Services, and everything in them that isn’t yours or a third party’s (the software and code, design, screens, text, graphics, icons and diagrams, and the OdoWorks name and logo), belong to MileWorks LLC or its licensors and are protected by copyright, trademark and other laws. We keep every right not expressly granted. Some components of the App are provided under open-source licences, whose terms govern those components; nothing in these Terms limits the rights those licences give you.

10. Your data and your content

Your log is kept on your phone: there’s no account and no server that holds it. Keep your own backup: Settings → Data → Your data → Export everything (CSV) makes a file you can keep anywhere, and the automatic backup (OdoWorks Plus) saves a fresh copy once a day. Neither one holds your photos, receipts, scanned documents or drive maps. Uninstalling OdoWorks deletes everything it keeps on the phone, and we can’t recover anything that was only on a lost, reset or erased phone.

What you enter in OdoWorks (your log, notes, photos and documents) is yours. We claim no ownership of it, and because it stays on your phone, we don’t receive it. You’re responsible for it and for having the right to keep it, including other people’s details, such as another driver’s after an accident: collect, keep and share them only as the law allows. Our Privacy Policy explains what the App sends to outside services and what your phone’s own backup may copy.

11. Estimates, not advice

OdoWorks works out fuel economy, costs, depreciation, loan figures, tax comparisons and other numbers from what you log and from public sources. They’re estimates to help you keep track, not financial, tax, legal or mechanical advice, and you’re responsible for the decisions you make with them.

  • Taxes. The IRS, CRA and SAT figures, the reimbursement report and the tax package are prepared from your log: check them with a tax professional before you file or claim anything. You’re responsible for your mileage log meeting your tax authority’s or employer’s rules.
  • Tracking. Automatic tracking and recorded trips can miss a drive or measure it wrong: check them against your odometer. OdoWorks isn’t an electronic logging device (ELD), an hours-of-service log or an IFTA record.
  • Money. A car’s value isn’t an appraisal; your lender’s loan figures are the ones that count; exchange rates are reference rates.
  • Places and days. Places, time zones and borders are approximate, and days abroad count the days with something logged: don’t use them for a visa, residency or tax limit, or as a customs record.
  • Photo reading and imports can misread a number: check what they fill in before you save.
  • Reports and images you share are yours to check. The vehicle history for a buyer isn’t an odometer disclosure statement or an official vehicle history report, and Settle up isn’t a bill or a payment service.

12. Safety information in the app

  • Safety recalls are matched by year, make and model, not your VIN, and can miss a recall or show one that doesn’t apply. Check your VIN at nhtsa.gov, with Transport Canada, or with your dealer.
  • The accident guide is a checklist, not legal or insurance advice. OdoWorks isn’t an emergency service: in an emergency, call the local number yourself. The number the App offers comes from where your latest drive was, if it was in the last few hours, or else from the region shown at the top of the App (with Automatic, where your newest entry was), so it may be wrong where you are now.
  • Tires. The legal minimum tread shown is a common one; yours may be higher, and tires lose grip well before it.
  • Reminders are a convenience and may not arrive. Photos of your documents aren’t official copies.

13. Data, names and services from others

OdoWorks shows data from public sources, such as the EPA (fueleconomy.gov), Natural Resources Canada, NHTSA, the U.S. Energy Information Administration, Statistics Canada, the European Commission’s Weekly Oil Bulletin, Western Australia’s FuelWatch, the European Central Bank, NASA and OpenStreetMap. We show them as published or as we’ve processed them; they can be late, incomplete or wrong, and we don’t control them. A feature that depends on an outside service may stop working if that service changes or stops.

Names and logos of car makers, fuel brands, charging networks, toll agencies, gig platforms and other apps belong to their owners. OdoWorks shows them only to identify your vehicles, stops and imports, and isn’t affiliated with or endorsed by them.

We’re not responsible for the practices of websites, apps or services linked to or from the Services, including the information or content in them; a link isn’t an endorsement, and your use of them is under their own terms.

14. Additional terms for App Store users

Apple’s App Store. If you download or use the App through Apple’s App Store, the following additional terms apply: (a) these Terms are between you and OdoWorks, not Apple, and OdoWorks, not Apple, is solely responsible for the App and its content; (b) the licence granted to you is a non-transferable licence to use the App on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including any use permitted through Family Sharing, volume purchasing or Legacy Contacts; (c) OdoWorks is solely responsible for maintenance and support of the App, and Apple has no obligation to furnish any maintenance or support; (d) to the extent any warranty has not been effectively disclaimed, if the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the App, and, to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App; (e) OdoWorks, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and consumer-protection, privacy or similar claims; and, if a third party claims that the App or your possession or use of it infringes that third party’s intellectual-property rights, OdoWorks, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim; (f) you represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and are not listed on any U.S. Government list of prohibited or restricted parties; (g) you must comply with applicable third-party terms when using the App, such as your mobile data plan’s; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of them, may enforce them against you as third-party beneficiaries.

For questions, complaints or claims concerning the App, contact MileWorks LLC as Section 21 says.

Google Play. If you download the App or buy a plan through Google Play, Google Play’s terms of service also apply to that download and purchase.

15. Notices and claims

If you believe that anything in the Services infringes a copyright or other right that you own or control, send a notice to us (Section 21) with: what you believe is infringed; where it is in the Services; your name and contact details; a statement that you believe in good faith that the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you own the right or may act for its owner; and your physical or electronic signature. We may give notice of a claim to affected users in the App or on the Site.

16. Ending these Terms

You may stop using OdoWorks at any time; uninstalling it ends these Terms for you (cancel any subscription first).

Without limiting other remedies, OdoWorks may suspend or end these Terms with you, or your use of the Services, at any time if: (a) you are in breach of these Terms; (b) you are engaged in illegal actions, or infringe proprietary, privacy, intellectual property or other rights of any person, or otherwise create risk or possible legal exposure for us; (c) required by applicable laws or regulations, within the time limits they set; (d) you are using OdoWorks in a way it wasn’t intended for; (e) you are abusing or causing extreme use of the Services or their resources; or (f) we decide to stop offering the Services generally. If we stop offering OdoWorks, the App on your phone keeps working with everything you’ve logged, though you may not be able to download it again or restore a purchase on a new phone.

When these Terms end, all licences and rights to use the Services end, and you must stop using them. Any suspension or ending doesn’t affect the parts of these Terms that by their nature are intended to survive it (including Sections 9 to 13, 17 and 20).

17. Exclusion of warranties, limitation of liability and indemnity

NO WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND USED AT YOUR SOLE RISK, WITH NO WARRANTIES WHATSOEVER. ODOWORKS DOES NOT MAKE ANY WARRANTIES, CLAIMS OR REPRESENTATIONS AND EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE SERVICES, INCLUDING WARRANTIES OR CONDITIONS OF QUALITY, PERFORMANCE, ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ODOWORKS FURTHER DOES NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE OR ERROR-FREE, OR THAT ANY FIGURE, RECALL, REMINDER, LOCATION, DRIVE OR OTHER DATA THEY SHOW WILL BE ACCURATE OR COMPLETE.

NO LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT ODOWORKS SHALL HAVE NO LIABILITY WHATSOEVER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES OR LOSSES HAS BEEN NOTIFIED TO ODOWORKS, IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICES. YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THEM AND CANCEL ANY SUBSCRIPTION.

FURTHERMORE, YOU ACKNOWLEDGE AND AGREE THAT NEITHER ODOWORKS NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE SERVICES SHALL BE LIABLE TO YOU, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES OR LOSSES HAS BEEN NOTIFIED TO ODOWORKS, FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES; (B) ANY LOSS OF INCOME, BUSINESS, ACTUAL OR ANTICIPATED PROFITS, SAVINGS, OPPORTUNITY, GOODWILL OR REPUTATION (WHETHER DIRECT OR INDIRECT); (C) ANY DAMAGE TO OR CORRUPTION OF DATA (WHETHER DIRECT OR INDIRECT); OR (D) ANY FINE, PENALTY, TAX, INTEREST OR REIMBURSEMENT YOU OWE OR LOSE.

IF, DESPITE THE ABOVE, ODOWORKS IS FOUND LIABLE TO YOU, ITS TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR ODOWORKS IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US$50.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING, WHERE APPLICABLE, LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

If any third party brings a claim against OdoWorks in connection with, or arising out of: your breach of these Terms; your breach of any applicable law or regulation; your infringement or violation of the rights of any third party (including intellectual property and privacy rights); or a report, record or image you made with the Services and gave to someone else, you will indemnify and hold OdoWorks harmless from and against all damages, liability, loss, costs and expenses (including reasonable legal fees and costs) related to that claim, to the extent the law where you live allows.

18. Privacy

We respect your privacy and the confidentiality of your personal information. Our Privacy Policy explains what the App keeps on your phone, what it sends to outside services and why, and the rights you have. Please read it before you start using the Services.

19. European Economic Area, United Kingdom and Switzerland consumers

If you are a consumer habitually resident in the European Economic Area, the United Kingdom or Switzerland, these Terms do not affect any rights or remedies that cannot lawfully be excluded or limited under the laws applicable to you. Any exclusion or limitation of warranties, remedies or liability in these Terms applies only to the extent permitted by applicable law. You may also have statutory cancellation, withdrawal, refund, conformity or other consumer rights in addition to the rights these Terms describe.

Wherever you live, some places don’t allow the exclusions and limits in Section 17, so they may not apply to you. Before OdoWorks is offered in Quebec or Mexico, these Terms will be published in French and in Spanish, with the changes their consumer laws require.

20. Miscellaneous

  • Entire agreement and severability. These Terms, the Privacy Policy and the App Store’s terms are the whole agreement between you and OdoWorks about the Services. If any provision of these Terms (or part of it) is found by any court or administrative body of competent jurisdiction to be illegal, invalid or unenforceable, that provision (or part) shall be removed from these Terms without affecting the legality, validity or enforceability of the rest.
  • No waiver. Our failure to exercise, or delay in exercising, a legal right or remedy given by these Terms or by law shall not constitute a waiver of that right or remedy.
  • Force majeure. If we are unable to provide the Services because of something beyond our reasonable control (such as an outage of the internet, an App Store, a public data service or a hosting provider, a natural disaster, war, or an act of government), we will not be in breach of our obligations to you under these Terms.
  • Governing law and courts. Except to the extent applicable law provides otherwise, these Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws provisions; for a consumer habitually resident in the European Economic Area, the United Kingdom or Switzerland, this doesn’t take away the protection of the mandatory law of the place where they live. Except where applicable law gives you the right to bring proceedings elsewhere (such as those consumers’ own courts), the exclusive jurisdiction and venue of any action about these Terms or the Services will be the state courts in Bernalillo County, New Mexico, and the U.S. federal courts for the District of New Mexico, and each party waives any objection to them. Before bringing a claim, please write to us (Section 21) and give us 60 days to put it right. We may seek injunctive relief in any jurisdiction where permitted by applicable law.
  • Transfer. We may transfer these Terms to a company that takes over OdoWorks; you may not transfer them.
  • Feedback. If you send us ideas or suggestions, we may use them freely, without paying or crediting you.
  • Notices. We give notices in the App or on this page. You agree that notices and agreements we give you electronically satisfy any requirement that they be in writing.
  • Language. These Terms were drafted in English (US). If we give you a translation, the English version prevails where they differ, unless the law where you live says otherwise.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THESE TERMS AND UNDERSTAND ALL THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET OUT IN THEM. BY CONTINUING TO USE THE SERVICES, YOU EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS AND GRANT ODOWORKS THE RIGHTS SET OUT IN THEM.
